These Terms of Use ("Terms") are a contract between you and G3 Tech LLC ("G3 Tech", "we", "us", or "our") covering Greenside Partee, our golf scoring and game-tracking service on the web at https://app.greensidepartee.com and as apps for iOS and Android (the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. WHO CAN USE GREENSIDE PARTEE
You must be at least 13 years old, or 16 where your country requires it, to create an account. If you are under 18, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms.
You need one account, it is yours alone, and you are responsible for what happens under it. Keep your password to yourself, and tell us at support@greensidepartee.com if you think someone else has your account.
2. YOUR LICENCE TO USE THE SERVICE
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Greenside Partee on devices you own or control, for your own non-commercial use, in line with these Terms and with the rules of the app store you installed it from.
You agree not to:
- Copy, modify, reverse engineer, decompile, or create derivative works of the app, except where that restriction is prohibited by law.
- Rent, sell, sublicense, or redistribute the Service.
- Use the Service to break the law, infringe anyone's rights, or run any real-money gambling operation.
- Interfere with the Service, work around its limits, scrape it, or attempt to access accounts or data that are not yours.
- Upload anything malicious, or anything designed to disrupt the Service or other people's use of it.
We may suspend or terminate an account that breaks these Terms.
3. SUBSCRIPTIONS, TRIALS, AND PAYMENT
Greenside Partee offers a free trial followed by a paid subscription. What you pay, what the subscription includes, and the billing period are shown before you buy.
Payments are processed by Stripe. Card details go directly to Stripe and we never see or store them. Subscriptions renew automatically at the end of each period at the then-current price until you cancel.
Cancelling. You can cancel at any time from Account > Subscription, which opens the Stripe billing portal. Cancellation takes effect at the end of the period you have already paid for; you keep access until then. If you bought through the Apple App Store or Google Play, manage or cancel the subscription in that store's own subscription settings instead, under that store's rules.
Refunds. Except where the law or the store you bought through requires otherwise, payments are non-refundable and we do not give partial refunds for unused time.
Price changes. If we change the price, we will tell you before it applies to you, and the change takes effect at your next renewal. You can cancel before then.
4. YOUR CONTENT AND YOUR GAMES
The scores, game settings, and other content you enter stay yours. You grant us the licence we need to run the Service: to store your content, and to show it to the other players in games and tournaments you join.
A game belongs to everyone in it. Other players can see your display name, handicap, scores, and results, and anyone who has a join link can see the game they were invited to.
You are responsible for what you enter. Do not put anything in a display name or other free text that is unlawful, abusive, or that infringes someone else's rights.
5. STAKES ARE NOT GAMBLING, AND WE ARE NOT INVOLVED
Greenside Partee lets you record stakes for the side games golfers play among themselves. Those figures are a scorekeeping convenience and nothing more.
G3 Tech does not accept wagers, hold stakes, process winnings, or transfer money between players. No money passes through the Service for these games. Whatever you settle with the people you played with is entirely between you and them, and it is your responsibility to make sure it is legal where you are.
6. THE COURSE AND CLUB DATA
Club, course, tee, par, and distance information comes from third-party and public data and is provided for convenience. It can be out of date or wrong. We are not responsible for scores, results, or handicap calculations that turn out to be affected by inaccurate course data — check anything that matters against the card in front of you.
7. AVAILABILITY AND CHANGES
We work to keep the Service running, but we do not promise it will always be available, uninterrupted, or error-free. We may change, suspend, or discontinue any part of the Service. If we discontinue a paid feature you are currently paying for, we will give you reasonable notice and a pro-rata refund for the unused part of your current period.
You need an internet connection and a compatible device. Your carrier's data charges are yours.
8. ENDING YOUR ACCOUNT
You can delete your account at any time from Account > Delete Account. Deletion is permanent: your name, email and sign-in are removed and any active subscription is cancelled. Finished games you played with other people keep your scores, against "Former player", because those rounds are theirs too. Deleting your account does not refund payments already made.
We may suspend or terminate your account if you break these Terms, if we are required to by law, or if we discontinue the Service.
9. DISCLAIMERS
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT SCORING OR HANDICAP RESULTS WILL BE ACCURATE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, G3 TECH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR FIFTY US DOLLARS.
Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
11. INDEMNITY
You agree to indemnify and hold G3 Tech harmless from claims, damages, and reasonable legal costs arising from your use of the Service, your content, your breach of these Terms, or any dispute between you and another player, including any dispute about stakes.
12. APPLE AND GOOGLE
If you installed Greenside Partee from the Apple App Store, you acknowledge that:
- These Terms are between you and G3 Tech only, not Apple. Apple is not responsible for the Service or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, legal or regulatory non-compliance, or consumer protection claims.
- Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party intellectual property infringement claim relating to the app.
- You represent that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you installed the app from Google Play, your use is also subject to the Google Play Terms of Service, and Google is not a party to these Terms or responsible for the Service.
13. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of laws rules. You and G3 Tech agree to the exclusive jurisdiction of the state and federal courts located in Pennsylvania, except that either of us may bring a claim in small claims court.
If you are a consumer resident in the EEA, the UK, or another jurisdiction whose law gives you the protection of your local courts and mandatory consumer rights, nothing here takes those away.
14. CHANGES TO THESE TERMS
We may update these Terms. The "Last updated" date at the top always reflects the current version, which is available in the app under Account > Terms of Use and at https://greensidepartee.com/terms-of-use.html. If a change is material, we will tell you by email or with a prominent notice in the app before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
15. GENERAL
If any part of these Terms is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. These Terms and our Privacy Policy are the entire agreement between you and G3 Tech about the Service.
